Brendan Cox and Gary Brook founded Waterfords estate agents in south east england in September 1995. Brendan started in estate agency in 1978 and Gary in 1984.

How many property investors do you think are wishing they had done more due diligence before they went ahead and committed to a purchase?
This post is to give you a heads up of where to begin, simply because I meet so many wannabe property investors and new landlords who just don’t know where to start. They often get approached by property sourcers as a result of visiting internet forums, attending a property networking meeting, subscribing to magazines or simply searching the internet. Before they know it their email inboxes get bombarded with offers of property deals advertising massive discounts and fantastic returns. As the seasoned professionals reading this will know, very few of these deals are as good as they might first appear.
My first piece of advice is never to completely trust a person who makes commission or charges fees for introducing property deals to you. Get everything they tell you checked out independently. If you know all the right questions to ask and where to get the answers for free than it’s just a matter of having the time to do it. However, if you are unsure or your time is valuable a great starting point is to invest £29.99 with Experian on a PropertyCheck. They provide 17 page reports for just £29.99 which is a small price to pay prior to investing any more of your valuable time and hard earned money. These reports provide a detailed valuation together with wide information including but not limited to energy usage, carbon emissions, schools, transport, crime, employment, flood areas, local services and a demographic profile of people living in the area such as age range, marital status, income, financial stress, family size, percentage of homeowners etc. As well as being an incredibly useful element of your due diligence process for making purchasing decisions these reports can also provide excellent independent backup to your own marketing information to pass on to prospective tenants.
If what you read in that report doesn’t put you off then you may want to see what mortgage deals are available without arranging to meet with your mortgage broker at this stage. You can also do this here by using our buy to let mortgage calculator. This will tell you who the top lenders are in the market and how they are pricing their mortgage products. The Buy to Let mortgage quote system is regularly updated and enables you to compare a wide variety of Buy to Let mortgages and see how these affect your returns.
If it looks like you can arrange the financing you need on terms which are acceptable then you really ought to consider all of the costs and returns. Don’t let time or lack of an accountancy qualification prevent you from crunching all the numbers, try our ‘Viability Calculator’. This tool is extremely quick and easy to use.
All of the above need not take you more than an hour and will cost you less than £30, a miniscule investment to make when compared to the massive commitment of purchase and ownership.
There is no substitute for taking a good look at the property and the area yourself though. If you are unsure of anything take a second look and take a good builder or surveyor with you.
If you decide to progress you will now want to instruct your solicitor and possibly a mortgage broker if you are not buying for cash. The mortgage lender will want to get an independent valuation done for their purposes and you will need to pay your solicitor to do searches. These professionals will provide advice to guide you from this point to completion of the purchase. Always use your own mortgage broker and solicitor. If you are told that you can’t then it’s probably time to walk away and move on to another deal. I suggest you send a private message to six of them in your area and ask them to provide details of their services, experience and charges. You can also use the directory to find letting agents and many of the other trades and professions associated with property ownership.
That’s not the end of the process, buying the property is the beginning of your journey to becoming a landlord. The above usually takes a few months but ownership could go on for decades. STAMP duty could be axed in a radical shake-up of the tax system.
It forms part of a review of Britain’s “inefficient, complex and unfair” taxation that could benefit the economy by billions of pounds and encourage work and saving.
The report by the Institute for Fiscal Studies, which it describes as the most far-reaching analysis of the UK tax system in more than 30 years, also recommends integrating income tax and National Insurance payments.
Targets for change include Inheritance Tax – which the Daily Express has crusaded to scrap – where the individual would be taxed and not the estate on a person’s death.
The IFS believes there is also a case for taxing gifts of cash over the recipient’s lifetime. But it says that exempting estates from capital gains tax should definitely stop.
The report describes housing taxation as “a mess” and recommends that instead of stamp duty, residents of larger houses would pay more council tax so that bills reflected real property values.

Review chairman Sir James Mirrlees, the Nobel Prize economist who gave his name to the five-year report, said: “The system imposes unnecessary costs on the economy.
“It reduces employment and earnings more than it needs to. It discourages saving and investment and distorts the form they take.
“It favours corporate debt over equity finance. It fails to deal effectively with either greenhouse gas emissions or road congestion.” The IFS believes the Government could raise as much money and distribute wealth around the population in about the same proportions as now but in much cheaper ways, by moving to the simpler system it recommends.

The Financial Services Authority (FSA) has today published the details of the regime that it aims to introduce on 1 July to tackle immediate problems for customers in the sale and rent back (SRB) market.
This follows HM Treasury’s announcement yesterday that it is extending the scope of FSA regulation to include SRB, as it considers this to be the most appropriate way of ensuring consumer protection in this market.
This supports the recommendation made last year by the Office of Fair Trading (OFT), following a market study which found that sale and rent back deals had the potential to cause serious harm to homeowners who are often already in a vulnerable position.
A recent FSA survey of 2,006 adults aged 18 and over interviewed across Great Britain found that:
- only 42% of those surveyed knew that SRB is currently unregulated (meaning that people who currently take part in these schemes do not benefit from the protection afforded by the Financial Ombudsman Service if needed);
- the majority thought they would be entitled to stay in their home for more than five years (whereas the typical contract is six to 12 months); and
- the majority (58%) surveyed thought SRB should be regulated.
The FSA is taking a two stage approach to regulating the SRB market. An interim regime will be brought in as soon as any statutory changes come into force (expected on 1 July) in order to address the most immediate problems for consumers, followed by a more comprehensive regime which will start on 30 June 2010.
Ed Harley, FSA head of mortgage policy, said:
"We know that some consumers enter into sale and rent back arrangements without understanding the costs and risks involved. This can be a source of real distress for people in already difficult circumstances. Firms entering our regime will need to run their business in a way that means customers are treated fairly. This includes making clear to customers important details, such as the length of time they can stay in the property, before they enter into the arrangement."
Under the interim regime firms will need to meet FSA threshold conditions including the requirement to have adequate resources and to be run by fit and proper people. Firms will also have to comply with the Principles for Businesses and meet a number of systems and controls and conduct of business rules.
Firms that are currently unauthorised and that intend to carry on any of the new SRB regulated activities after the commencement of the interim regime will need to apply for interim permission. Similarly, firms that are currently authorised for other activities will need to apply for interim variation of permission. Firms are encouraged to start preparing now for authorisation and to apply as soon as the interim regime starts.
Notes for editors
- The policy statement ‘Regulating sale and rent back: an interim regime’ is available on the FSA website.
- SRB schemes involve individuals selling their home, usually at a discount, and obtaining an agreement to remain in the property for a set period - typically through an assured shorthold tenancy of six to 12 months.
- On 2 June HM Treasury published a response to its consultation document, ‘Regulating the sale and rent back market: a consultation’ (published in February). This can be found on its website www.hm-treasury.gov.uk
- The consumer research quoted was conducted by TNS with a representative sample of 2,006 adults aged 18+ interviewed across Great Britain between 1 and 5 April 2009.

The FSA has published some information on its website to help firms prepare for interim authorisation and shall shortly publish sample application forms on its website to give firms additional help. The key dates for the regulation of sale and rent back are as follows:
- 1 July 2009: interim regulation expected to begin and firms can start to submit applications for interim permission or interim variation of permission;
- 1 August 2009: the closing date for interim permission applications;
- September 2009: expected publication of Consultation Paper on full regime for sale and rent back; and
- 30 June 2010: SRB regulation under the full regime will begin.
- The FSA regulates the financial services industry and has four objectives under the Financial Services and Markets Act 2000: maintaining market confidence; promoting public understanding of the financial system; securing the appropriate degree of protection for consumers; and fighting financial crime.
- The FSA aims to promote efficient, orderly and fair markets, help retail consumers achieve a fair deal and improve its business capability and effectiveness.

What Are Capital Allowances?
When you spend money buying or improving a property, HMRC allows you to offset some of that expenditure against your profits, or general income for tax purposes.It’s your statutory right to claim

By allowing a retrospective or current acquisition claim based on the purchase price. It is not a contentious tax avoidance scheme or loophole but is based on established UK statutory law dating back to 1878.

Will I qualify?
To claim capital allowances you (or your company) must satisfy the following criteria:
- You are a UK taxpayer (Income Tax or Corporation Tax)
- You own a UK commercial property with a minimum purchase of £200,000
- OR you own a furnished holiday property either in the UK with a minimum purchase price of £200,000 or within the EEA with a minimum purchase price of £300,000 (collectively)
- The property is not held fully within a pension fund, charity, government owned or traded as stock

Upset with the bad name that poorly trained novices and casual part-timers were giving the real estate profession, Dave Liniger in 1973 started a real estate company in Denver that would limit itself to hiring only full-time, experienced professionals. He wanted a company where homebuyers and sellers could walk into any office in any market, confident they would receive the level of professional service that a transaction of such magnitude demands. … Continuous growth Although RE/MAX growth in the early years wasn't exactly stellar, the company has grown every month since its founding. The concept that seemed so logical and powerful to Dave Liniger, was extremely threatening to the industry status quo. Concerted efforts were made to impede the company's growth. At the close of 1973, there were just 21 agents and eight offices. By 1976 there were 100 agents and by 1977, with 480 agents in the system, RE/MAX gained No. 1 market share in its headquarters city of Denver. That same year, the company expanded into Canada. In 1978, RE/MAX added its 100th office and 1,000th agent - and the hot air balloon became the company's official corporate logo. By 1980, the organization had 3,000 agents. We will not tie you into a prolonged contract you can’t get out of. Minimum term contracts only serve the interests of the Agent, if an agent is confident they can provide you with the level of service you expect, why do they need to lock you in?
We will not charge you a fee to withdraw your property from the market, nor will we charge you for press or internet advertising. Charging advertising separately is just another way of locking you in, many clients who’ve come to us after trying this approach have paid out hundreds of pounds in advertising charges to their prior agent, just to end up taking their house off the market to start again.
We do not employ receptionists. All our sales staff are paid on commission, at levels higher than the industry norm giving a strong incentive to look for every opportunity. They want to sell as much as you do.
We do not bombard buyers with automated emails and text messages. Our negotiators work on their own initiative and contact buyers verbally. Fancy software won’t sell your property, they will.
We offer genuine multi branch coverage. Many multi office agencies claim to offer the benefit of additional exposure through their other branches, though in practice this rarely happens as there’s no incentive for the staff. We use the same sort of marketing & advertising materials they do, it’s our belief in recruiting and rewarding good sales people that made the difference.
We offer you complete freedom in marketing your property, our agreements do not have any ‘small print’. Consider agents terms very carefully before signing. A previous client of ours was billed by a former estate agent for merely providing a buyer with a sales brochure, would you be happy paying £3,000 for that?.
Good communication is key to selling. The No1 complaint we hear from people who’ve come to us having already spent time on the market with another agent is lack of feedback. If you don’t know what the market thinks how can you make the right decisions?. In addition to direct feedback from viewings, we give market review calls to clients on a 2/3 week basis.

Just two months since its launch Property118.com claims to be the fastest growing online community for property investors and buy to let landlords. In this interview Paul Fieldson, founder of bidonmyhouse finds out more from Mark Alexander the founder of Property118.com.
Paul: Why do you think the new web-site has taken off so quickly Mark?
Mark: We were very lucky to have a huge database of landlords to introduce to the new web-site but we’ve also been impressed by how many former clients of The Money Centre have told their friends about the site.
Paul: The name 118 implies that the site is a directory but when I had a look a few weeks ago it seemed to be more of a News site, can you explain?
Mark: The site is indeed going to be a directory but with a twist. We recently conducted a survey of 100,000 landlords on our database and 78% of the respondents said that they prefer to rely on peer to peer recommendations when they need a new trade or professional contact. In other words, Landlords prefer to act on recommendation from other landlords as opposed to trusting paid for advertising. Therefore, our Directory will be built by members for members. The News element of the site was established to attract the interest of search engines as well as the landlord community prior to launching the full functionality which takes a lot more programming and investment.
Paul: Have you had any problems from the men with moustaches for using the name 118?
Mark: Not at all, 118 is the prefix number for all telephone directories in the UK following the de-monopolisation of the directory enquiry service. The men with moustaches don’t own the 118 prefix and numbers alone can not be trademarked.
Paul: You mentioned “full functionality”, can you explain further?
Mark: Yes, we want Property118.com to become an online community for property investors where they can share best practice, trusted/reliable/competitive professional and trade connections and also utilise Number Cruncher tools in a secure environment to analyse their portfolio’s and future investment decisions.
Paul: You mentioned security which is obviously very important if people are imputing sensitive information and using the web-site to analyse their investment, how does this work.
Mark: The secure areas of our web-site use the same security technology as online banking. For those who are into tech, it’s known as SSL certified encryption over an https:// URL
Paul: How much does the service cost?
Mark: That’s the best bit Paul. Membership of Property118.com is completely free. The entire operation will be funded through premium listings of trades and professionals.
Paul: Could that compromise the integrity of the site?
Mark: Absolutely no way. We only offer premium listings to companies who are recommended by members. This enables Members to see how many recommendations each trade or professional person has and which Members recommended them. It’s a true Peer to Peer recommendation. We don’t sell leads and we do not email our members on behalf of other companies. If we feature a services of a business in our web-site, as we have done for bidonmyhouse, we do so based on merit, not the size of their advertising budgets.

We can attempt to work these deals by our experienced property team and offer a number of options to the clients. There is the potential for you to make some money from what is dead and cold to you.

A fresh approach

We all know in the industry that the market is slow. How many agents have rows of unsold properties receiving no viewings or interest. bidonmyhouse is not a typical auction site for typical auction type properties.
Agents are starting to embrace our ideas realising some new approach is required. Rather than trying to sell a property at an optomistic asking price which will stimulate little interest, we suggest the vendors start at an interesting price to create interest and let the buyers bid. An open market price should be achieved quicker rather than vendors having to reduce the asking price several times. This is annoying to the vendors and embarrassing to the agent.

Agents cannot afford to have rows of properties sat in their shops unsold. Estate agents need to embrace new methods to entice viewings,offers and sales. bidonmyhouse is not an auction site for the typical auction type property. Unachievable asking prices are of no use to anyone. The vendors are unhappy and the agents make no sales.
bidonmyhouse is an online bidding method were properties can be offered at an interesting starting price to stimulate buyers with a view to them bidding up to an open market price. This method is quicker rather than an unachievable asking price having to be reduced several times which is annoying to the vendors and embarrassing to the agent.
